Wish has a strict zero-tolerance policy regarding counterfeit products and intellectual property infringement. Merchant agrees that this will not limit Wish’s rights under this Agreement or its legal rights, and Wish may unilaterally suspend or terminate Merchant’s selling privileges or withhold or forfeit any payments that would otherwise be paid to Merchant if Wish determines in its sole discretion that Merchant is selling counterfeit products.

(1) Selling counterfeit products is strictly prohibited.

Selling products that imitate or mimic the intellectual property of another party is strictly prohibited. If Merchants list counterfeit products for sale, those products will be removed and their accounts will be subject to fines and may even be suspended.

(2) Selling products that infringe another entity’s intellectual property is strictly prohibited.

Product images and text must not infringe on the intellectual property of another party. This includes, but is not limited to, copyrights, trademarks, and patents. If Merchants list products that infringe on the intellectual property of another party, those products will be removed and their accounts will be subject to fines and may even be suspended.

(3) Merchants are responsible for providing proof of authorization to sell products.

If a product is counterfeit or infringes on the intellectual property of another party, the Merchant is responsible for providing proof of authorization to sell the product.

(4) Providing inaccurate or misleading sales authorization evidence is strictly prohibited

If a merchant provides false or misleading authorization evidence for the products they sell, their account will be suspended. (5) Fines for counterfeit products or products that infringe intellectual property rights

All products will be reviewed to see if they are counterfeit or infringe intellectual property rights. If a product is found to violate Wish’s policy, it will be deleted and all payments will be withheld. Merchants will be fined $1.00 for each counterfeit product.

(6) Counterfeit fines for approved products

After a merchant changes the product name, product description or product image, the approved product will be reviewed again, mainly to see if it is a counterfeit or infringes intellectual property rights. During the product review period, the product will be sold normally. If a product is found to violate Wish’s policy after editing, the merchant will be fined $100.00. This product will be deleted and all payments will be withheld.
