As a novice seller, you accidentally fell into the trap. A product you released was complained of infringement by a foreign seller. How to deal with it?
1. View the details of the complainant and the complained product.
Log in to Alibaba’s intellectual property protection system with your main account and password to view the details. After logging in, you can see “Complaints to be responded to” and “Historical complaint records” under the “Complaint Management” module. Find the corresponding complaint, click “Intellectual Property Number” to view the intellectual property details, click the name of the complainant under “Complainant” to view the complainant’s contact information and other information, and click “Handle Now” or “View Now” to view the specific complained product information.
Click “View Now” in the “Historical Complaint Records” column, and then click “View Snapshot” to view.
View the details of the intellectual property trademark of the right holder. The patent information retrieved from this link is the English translation version of the patent information of the relevant country. The country code of the relevant country needs to be added before the patent number, such as DE for Germany, US for the United States, FR for France, JP for Japan, etc. Check the Alibaba platform brand reference list.
2. Actively respond to complaints. If you think it does not constitute infringement or has reasonable brand authorization, you can file a counter-notification appeal.
Log in to Alibaba’s intellectual property protection system. Click “Complaints to be responded to” in “Complaint Management” to initiate a counter-notification for complaints whose links have not been removed. You can also initiate a counter-notification for historical complaint records: click “Historical Complaint Records” in “Complaint Management” to view the case status.
You can also contact the complaining party to negotiate and withdraw the lawsuit to resolve the problem. Log in to the intellectual property protection system, find the corresponding complaint information, click “Complaining Party Information” to view it, and after viewing the complaining party’s contact information, contact the other party for communication.
3. If the product information involves brand infringement, the product should be checked and cleaned up in time to avoid repeated infringement.
Log in to the intellectual property protection system, and you can view the intellectual property information and contact information of the complainant under “Complaints to be responded to” or “Historical complaint records” in the “Complaint Management” module. Click “Process now” or “View now” to see the link to the complained product. If you have no objection to the complaint, you can click “Delete now.”
In the MyAlibaba backend-product management-full-text search tool, the text information of the approved products (excluding pictures) can be retrieved through a complete English word to retrieve the products involved in the word, which is convenient for self-management and investigation of infringing product information. If the search term entered exists in the name, keywords, self-filled attributes, or detailed description of the product, it needs to be deleted in time.
