Every merchant has to register a trademark for his own company, only in this way can some minor problems be avoided. So, what is the process of international trademark registration in the United States? This article will introduce it.
1. Submission of registration application.
After the merchant submits the application to the US Trademark Office, he needs to wait patiently. The department will assign the application number within 1-2 days. After the application number is assigned, about two weeks later, the merchant can find relevant successful registration information at the US permanent office or the Trademark Office.
2. Registration review.
Then, the next step is to review the form and substance. At this time, the operational review will take about 2-4 months. If it really meets the basic requirements of the department, complies with the legal provisions and does not conflict with other conditions, the review department will publish the trademark registration situation.
3. Registration review opinion stage.
It should be noted here that during the review process, if the trademark department finds that the merchant always refuses registration for some nonsensical or substantial reasons, it will issue an official opinion, and the merchant must respond to the official opinion. If the merchant does not respond, the application will be deemed invalid (unless it is an official opinion on some products). There is a six-month response period from the date of the official opinion. After the reply is passed, an announcement will be issued. If the reply is not passed, the staff will issue the final opinion, which can only be announced after the problem is solved. Otherwise, it will be rejected in the end.
4. Registration announcement stage.
If after the review period, it is found that the merchant does not have any problems and does not meet the requirements for the rejected trademark registration, then the trademark will be published in the trademark announcement, which will be published online every week, about 1 month after approval. The trademark will be published in the trademark announcement. The announcement period is 30 days. Anyone can raise an objection to the Trademark Office. If there is no objection, the platform will register it after three months.
5. Registration stage.
If no objection is received one month after the trademark is announced, the Trademark Office will approve the registration. It should also be noted that an oath must be taken in the 5th or 6th year after the registration to maintain the validity of the trademark rights.
