In recent years, with the high attention of the state and the active participation of all sectors of society, my country’s intellectual property protection has achieved remarkable results, and the social satisfaction with intellectual property protection has continued to improve. On April 26, 2018, the State Intellectual Property Office released the “2018 Intellectual Property Protection Social Satisfaction Survey Report”. The survey report shows that my country’s social satisfaction with intellectual property protection has increased from 63.69 points in 2012 to 76.88 points in 2018, an increase of 13.19 points, and has generally entered a good stage.
On June 28, 2018, the Information Office of the State Council issued the White Paper “China and the World Trade Organization”, which is the first time that China has issued a white paper on this issue. The full text of the white paper is about 12,000 words. In addition to the preface and conclusion, it includes four parts. In the first part, “China’s practical implementation of its commitments to join the WTO”, the white paper specifically introduces my country’s implementation of its commitments to intellectual property protection.
1. Strengthening intellectual property protection is China’s proactive action
Strengthening intellectual property protection is the most important content of improving the property rights protection system and the greatest incentive to improve China’s economic competitiveness. China’s promotion of intellectual property protection not only meets its own development needs, but also helps to further improve the legal, international and convenient business environment. China encourages Chinese and foreign companies to carry out normal technical exchanges and cooperation, and protects the legitimate intellectual property rights of foreign-funded enterprises in China in accordance with the law. At the same time, it hopes that foreign governments will strengthen the protection of Chinese intellectual property rights.
2. Build a complete legal system for intellectual property protection
After joining the WTO, China has established and improved intellectual property laws and regulations, established intellectual property working mechanisms with many countries, actively absorbed and learned from international advanced legislative experience, and built an intellectual property legal system that conforms to WTO rules and China’s national conditions. In recent years, the Trademark Law has been revised to add a punitive compensation system; the Anti-Unfair Competition Law has been revised to further improve the protection of trade secrets, while clarifying market confusion, introducing the concept of logos, and broadening the scope of protection of logos. At present, the revision of laws such as the Patent Law and the Copyright Law is being accelerated.
