When stipulating the product name clause, the following matters should be noted:
(1) The imported goods must be legal and compliant. Before signing an import contract, the importer should understand the imported goods, especially the intellectual property rights such as brands and trademarks.
The importer needs to pay attention to whether China allows the import of the goods and from which countries China allows the import of the goods. Only by complying with national laws, regulations and policies can the goods be imported and cleared smoothly.
(2) The name of the goods must be clear and specific. The scientific name or the internationally accepted formal name of the goods should be used. The name should accurately reflect the characteristics of the goods and avoid vague and general provisions to avoid misunderstandings and trade disputes. In addition, the accessories attached to the whole set of goods should be listed in the annex table of the contract.
(3) If a local name is used, the two parties should reach a consensus on the meaning in advance; the naming and translation of the new product should be accurate, easy to understand, and in line with international customary names.
Due to language and cultural differences between countries, the translated product name must reach a consensus. If the language cannot accurately express the name of the imported goods, the quality of the sample can be expressed in the quality clause of the contract.
(4) The name of the product specified in the clause must be the product that the seller can supply and the buyer needs. Any descriptive words that are impossible or unnecessary should not be included.
(5) Pay attention to choosing appropriate product names to help reduce tariffs, facilitate imports and exports, and save freight expenses. The tariff rate, freight rate, insurance rate, etc. of imported goods are all related to the product name. The product name is sometimes also related to the trade control system. When choosing a product name, you should try to facilitate customs clearance, save taxes, and save various expenses.
(6) Pay attention to the impact of naming on buyers (consumers). Importers should give new imported products a nice and catchy Chinese name. When importers give Chinese names to imported goods, they need to negotiate with exporters on issues such as the right to name, the ownership of intellectual property rights of brand names, and trademark registration and promotion of imported domestically sold goods.
