The regulations are implemented in accordance with the Announcement No. 194 of 2018 of the General Administration of Customs on the Supervision of Cross-border E-commerce Retail Import and Export Commodities.
(1) Cross-border e-commerce platform enterprises, logistics enterprises, payment enterprises and other enterprises involved in cross-border e-commerce retail import business shall register with the local customs according to the relevant regulations on the registration and management of customs declaration units; foreign cross-border e-commerce enterprises shall entrust domestic agents (hereinafter referred to as domestic agents of cross-border e-commerce enterprises) to register with the local customs of the agent. Cross-border e-commerce enterprises, logistics enterprises and other enterprises involved in cross-border e-commerce retail export business shall register their information with the local customs; if they need to handle customs declaration business, they shall register with the local customs. Logistics enterprises shall obtain the “Express Delivery Business License” issued by the national postal administration department.
Under the direct purchase import model, logistics enterprises shall be postal enterprises or inbound and outbound express operators that have completed the customs declaration registration procedures with the customs. If the payment enterprise is a banking institution, it shall have a “financial license” issued by the China Banking and Insurance Regulatory Commission (hereinafter referred to as CBIRC) or the former China Banking Regulatory Commission (hereinafter referred to as CBRC); if the payment enterprise is a non-bank payment institution, it shall have a “payment business license” issued by the People’s Bank of China, and the scope of payment business shall include “Internet payment”.
(2) Enterprises participating in cross-border e-commerce retail import and export business and registered with the customs shall be included in the customs credit management, and the customs shall implement differentiated customs clearance management measures according to the credit rating.
