Search whether the patent can be searched → Sign a confidentiality agreement → Organize the technical briefing book → Sign an agency agreement → Write the application materials and confirm → Submit for acceptance → Patent examination → Patent authorization payment → Receive the certificate → Annual fee monitoring.
2. The process of EU design patent application.
a. Application process: Official receipt 2 to 4 weeks after application, and there is an acceptance number.
b. Time required from application to authorization: 3 to 4 months.
c. The EU design adopts the Locarno Classification (LOC).
d. Examination: The EU Trademark Office only examines the application based on the following two absolute reasons for rejection: whether the main object meets the definition of design; whether the design violates public order and good morals.
e. Announcement grace period: A 12-month announcement grace period can be provided to enable designers to verify the possibility of commercial success before registration.
f Delayed publication: If the applicant does not want to publish the design immediately, he can request a delayed publication. If the publication is delayed, the longest extension can be 30 months. If you want to apply for cancellation of the extension, you can request the publication of the design at any time, but if you choose not to publish it from the beginning to the end, the registration will expire after 30 months. Generally, the application for publication should be made in the 27th month at the latest.
g. Protection period: The protection period of the EU design is 5 years from the date of application. After the expiration, it can be renewed 4 times, each time for 5 years, and the maximum protection period is 25 years.
