Penalties for Intellectual Property Violations
Article 7 of Dunhuang.com’s “Penalties for Intellectual Property Violations” clearly stipulates violations and corresponding penalty rules. For sellers who have committed multiple infringement violations or serious violations, the platform has the right to directly close their accounts. Each violation penalty record is valid for one year from the date of the penalty; if a seller’s account is complained about multiple times or multiple products by the same intellectual property owner within three natural days, it will be counted as one valid complaint.
Liability for penalties for intellectual property violations
Article 8 of Dunhuang.com’s “Penalties for Intellectual Property Violations” explains the liability for penalties for violations, which mainly include the following.
(1) Dunhuang.com has the right to pursue relevant losses and legal liabilities for any economic, legal and reputational losses caused by intellectual property infringement.
(2) If a seller’s sale of infringing goods or banned goods leads to complaints from third parties such as brands, credit card organizations and other international rights organizations, and if the seller is fined by the brand, credit card organization or other international rights organization, the fine shall be borne by the seller. Dunhuang.com has the right to deduct the corresponding fine from the seller’s fund account. If the balance in the fund account is insufficient to pay the corresponding fine, DHgate.com reserves the right to deal with the seller’s account and take legal action.
