Wish has a strict zero-tolerance policy for counterfeits and intellectual property infringement.
If Wish unilaterally determines that a merchant is selling counterfeit products, the merchant agrees not to limit Wish’s rights in this Agreement or legal rights, and Wish may unilaterally suspend or terminate the merchant’s sales privileges or withhold or forfeit the payment that should have been paid to the merchant.
I. Prohibited Behaviors Regulations of the Platform
1. It is strictly prohibited to sell counterfeit products
It is strictly prohibited to sell products that imitate or allude to the intellectual property rights of other parties. If a merchant launches counterfeit products for sale, these products will be removed and their accounts will face fines and may be suspended.
2. It is strictly prohibited to sell products that infringe on the intellectual property rights of another entity
Product images and texts must not infringe on the intellectual property rights of other parties. This includes but is not limited to copyrights, trademarks, and patents. If a merchant lists products that infringe on the intellectual property rights of other parties, these products will be removed and their accounts will face fines and may be suspended.
3. Merchants are responsible for providing evidence of authorization to sell products
If the product is counterfeit or infringes intellectual property rights, merchants are responsible for providing evidence of authorization to sell the product.
4. It is strictly prohibited to provide inaccurate or misleading evidence of authorization to sell
If a merchant provides false or misleading authorization evidence for the products sold, their account will be suspended.
II. Penalty standards stipulated by the platform
1. Fines for counterfeit products or products that infringe intellectual property rights
Review all products to see if they are counterfeit and whether they infringe intellectual property rights. If a product is found to violate Wish’s policy, the platform will delete it and withhold all payments. Merchants may be fined $1 for each counterfeit product.
2. Fines for counterfeit products on approved products
After the merchant changes the product name, product description or product image, the approved products must be reviewed again to see if they are counterfeit or infringe intellectual property rights. During the product review period, the product is sold normally. If a product is found to violate Wish’s policies after editing, the merchant may be fined $100. The product will be removed and all payments will be withheld.
