The Budapest Treaty on the International Recognition of the Deposit of Microorganisms for the Purposes of Patent Procedure, referred to as the Budapest Treaty on the Deposit of Microorganisms or the Budapest Treaty, is one of the special agreements concluded by the member states of the Paris Convention for the Protection of Industrial Property. It was adopted by the Budapest Diplomatic Conference on April 27, 1977 and amended on September 26, 1980. The main feature of the Budapest Treaty is that the contracting parties that allow or require the deposit of microorganisms for the purpose of patent procedures must recognize the deposit of microorganisms submitted to any “international depositary authority”. Such recognition shall include recognition of the fact of deposit and the date of deposit as stated by the international depositary authority, as well as recognition that the sample provided as a sample is a sample of the deposited microorganism. The contracting parties form the “Budapest Union” in accordance with the treaty. The administrative work of the Union is entrusted to the International Bureau of the World Intellectual Property Organization. The member states of the Union must be members of the Paris Convention.

The Protocol relating to the Madrid Agreement concerning the International Registration of Marks, referred to as the Madrid Protocol, was signed in 1989 and came into force on December 1, 1995. In order to implement the protocol, the implementing rules applicable to both the Madrid Agreement and the Madrid Protocol were adopted and came into force on April 1, 1996, which was also the date of entry into force of the Madrid Protocol. Like the Madrid Agreement, the Madrid Protocol enables trademark owners of member countries to obtain trademark protection in other member countries by submitting an application to the International Bureau of the World Intellectual Property Organization through the trademark office of their location.
