In the process of engaging in e-commerce, enterprises must attach great importance to the investigation and research of relevant foreign legal mechanisms, analyze whether the products and services they provide have legal risks of intellectual property infringement, and make active preparations for response.
(1) Plan the patent work of the enterprise from the perspective of development strategy and establish a sound patent management mechanism. For example, establish a special agency, strengthen professional forces, formulate rules and regulations, and implement working funds.
(2) When launching and implementing technology research and development projects, it is necessary to clarify the job responsibilities of the participants and determine the ownership of intellectual property rights. In particular, when co-developing or entrusting scientific research institutes to carry out technology development, it is even more important to clarify the issue of patent ownership.
(3) Establish an intellectual property confidentiality system. Reasonably determine the confidentiality level of the enterprise’s intellectual property rights. Employees have the obligation to protect the enterprise’s intellectual property rights. In particular, when enterprises introduce or employ professional and technical personnel, they should clearly specify the content of intellectual property protection and non-competition clauses in the labor contract.
(5) Establish a patent tracking mechanism for the enterprise, search for the latest patent technologies at home and abroad, and on this basis, establish the research and development direction to ensure the advanced and cutting-edge nature of the research and development technology.
(6) Pay attention to the improvement of the enterprise’s independent innovation capabilities, accelerate the technological update of traditional products, accelerate the research and development of innovative products, and apply for patent protection in a timely manner.
