Every seller who places a package filled with products on the German market must register with the German Packaging Law. The new packaging law also lists that sellers must provide branded packaging when selling. Let’s take a look at how sellers need to complete it. .

1. Private label packaging

List private brands/retail brands to determine the product packaging that the seller will launch in the German market for the first time as a manufacturer.

It not only includes the seller’s own trademark brand. It applies to all own brands, as the original distributor puts packaging on the German market.

2. Third-party brand packaging

If the seller is a packaging manufacturer/initial distributor (for example, as an importer of German goods), the seller only needs to list the third-party brand .

If the seller is a downstream seller, the seller should not under any circumstances list the brand name of third-party goods/retail packaging that the seller purchased from German wholesalers or manufacturers. The seller is not responsible for this; the wholesaler or manufacturer.

3. Shipping, services and other packaging without brand name

You can enter the seller’s company name into the brand name under the brand name.

Example: A company sends packaged goods in neutral shipping packaging without any identifiable brand name. The company name should be listed. Do not list the manufacturer’s name for empty packaging materials.

If there is no brand name on the service package and the seller has transferred the system participation rights to an upstream reseller (such as a supplier or wholesaler) but has not filled the package, please provide the company name of the upstream reseller as brand name.

4. Shipping packaging with brand name

For cargo packaging, brand name refers to the text on the cargo packaging used to distinguish the service (transportation) from other transportation service providers.

If the brand name can be seen on the seller’s product packaging, list the name. Do not enter the brand name or any other description used by the manufacturer of the packaging material. If the seller uses unbranded product packaging, please register the seller’s mail order company name/company name.

5. Service packaging with a brand name

For service packaging, the brand name refers to the text written on the service packaging to distinguish it from other service packaging. For example, this could be the seller’s brand name or the brand name of an upstream distributor or manufacturer.
