Copyright legislation in the United States is basically consistent with international treaties. The object of protection is not the author, but the publisher and society. The content of copyright includes economic rights but not personal rights. The scope of protection includes all original intellectual achievements. Digital works are also included in the copyright protection framework. The protection strength has exceeded the two international copyright treaties, the World Intellectual Property Organization Copyright Treaty and the World Intellectual Property Organization Performances and Phonograms Treaty. However, my country focuses on protecting personal and property rights of copyright, but the objects of protection are still relatively vague. The description of the scope of protection in my country’s Copyright Law is not complete, especially related rights, undisclosed information, integrated circuit design and new scientific and technological products have not been included in the scope of protection. There is also a certain conflict with the Agreement on Trade-Related Aspects of Intellectual Property Rights in the scope of compulsory licensing and fair use. The performance of copyright risks is mainly concentrated on the infringement of the right of reproduction, dissemination, and distribution, the infringement of the right of information network dissemination, and the infringement of databases.

Infringement of the right of reproduction, dissemination, and distribution

Copyright protection in the traditional environment, such as the right of reproduction, dissemination, and distribution, belongs to the copyright owner. These rights protection models have been basically mature in the traditional environment. In the cross-border e-commerce environment, the copyright owner’s right to reproduce, disseminate and distribute the work is under serious threat. Infringers can easily disseminate the work without authorization and permission from the right holder.

In the process of cross-border e-commerce operations, it is common to see the digitization of unauthorized and unlicensed works, and the conversion of text, images, music, etc. into digital information that can be read by computers and then transmitted over the Internet. Such behavior is not creative and is an infringement of the original right holder’s right to reproduce, disseminate and distribute.
